Abstract


AN EVALUATION ON ALTERNATIVE SOLUTION WAYS IN INDIVIDUAL BUSINESS DISPUTES IN TURKEY
When the intensive workload of the business judge, which is the main solution method of the individual labour disputes,is taken consideration,the importance of the alternative solution methods is clear. İn the strong countries of the Europe,such as the United Kingdom,Germany and France,conciliation is actively applied from these methods.By enacting and enforcing the obligatory conciliation bill,which is also on the agenda in our country, the parties will allow the independent and objective third party to provide solutions in accordance with the conditions and characteristics of the concrete event,which they think will help in the solution of the dispute.By negotiating parties on this solution proposal, they will be able to reach at a consensus, thus reducing the burden of business judgment significantly. In this study we draw your attention to how the conciliation which the draft of proposed law for the work judgment bring with plays a role in relieving the workload of judge and providing the peace of work, and what principles it should be based on in order that the private judge application could be useful. With the obligatory conciliation practice, working peace in Turkey will be strengthened and the country will be opened to a considerable extend.
