Abstract
Fıkıhçılar (Allah onlara rahmet etsin) kuduz olan ve faydası dokunmayan köpeklerin alışverişlerinin haram olduğu hususunda ittifak etmişlerdir. Bunun dışındaki diğer köpeklerin alım-satım işlemlerinin hükmü hakkında ise iki görüşe ayrılmışlardır. Bazı müctehidler, kuduz olan ve faydası olmayan köpeklerin dışında kalan köpeklerin alım satımlarının hükmünü yasaklarken diğer müctehidler ise bunu caiz görmüşlerdir. Bu araştırmada, köpeklerin alım ve satımını haram veya helal sayanların mezhepleri, delil, ta’lil ve gerekçeleri belirtilmektedir. Delil ve delalet yöntemleri geniş tutularak, nassların kaynaklarının tahriçleri yapılırken cerh ve ta’dil imamlarının, usta eleştirmenlerin sözleri derinlemesine incelenmektedir. Deliller tartışılırken veya muhalif mezhebe cevap verilirken usûl imamlarının kıymetli sözlerine yer verilmektedir. Zira onların bu sözlerinin altında çok ince ilimler yatmaktadır. Örneğin Ebû Dâvûd’un hadisinden sonra Ebû Dâvûd (Sünen’inde) ve Münzirî’nin (Muhtasar’ında) sükût etmesi veya Müstedrek hadisinden sonra Hâkim (Müstedrek’inde) ve Zehebî’nin de (Telhîs’inde) o hadis hakkında sükût etmelerinin manası; o hadisin sıhhatine itiraz etmeyerek hadisin derecesinin hüküm çıkarılmaya uygun (sâlih) olduğunu yani onun sahih veya hasen hadis olduğunu onayladıkları anlamına gelmektedir. Yine hüküm çıkarırken nasslarda bulunan delâlet yöntemlerini ve eşit deliller arasındaki tercihlerin yöntemlerini iyi bilen müctehit ve fakih imamların bu konu hakkındaki sözlerini nakletmek, ilim isteyenleri anlayışlı ve bilinçli kılmaktadır.

Abstract
The scholars of Fiqh (may Allah have mercy on them) are unanimous that the sale of rabid and useless dogs is haram. As for the ruling on the sale and purchase of other dogs, they are divided into two opinions. Some mujtahids forbid the sale and purchase of dogs other than rabid and useless dogs, while other mujtahids consider it permissible. In this study, the sects, proofs, ta'ill and justifications of those who consider the buying and selling of dogs haram or halal are stated. The methods of evidence and proof have been broad, the words of the imams of cerh and ta'dil and the master munjakids have been analysed in depth, and the sources of the texts have been mentioned. While discussing the evidence or responding to the opposing sect, the valuable words of the imams of usul al-ma'ūl have been included. Because there is a very fine science behind these words. For example, the silence of Abu Dawud (in his Sunan) and Munziri (in his Mukhtasar) after the hadith of Abu Dawud, or the silence of Hakim (in his Mustadrek) and Zehebî (in his Talhîs) after the hadith of Mustadrek, means that they do not object to the authenticity of that hadith and confirm that the degree of the hadith is suitable for judgement (sâlih), that is, it is a sahih or hasan hadith. In addition, quoting the words of the mujtahid and faqih imams who know the methods of evidence in the nass and the methods of preference between equal evidence when making judgements makes the seekers of knowledge understanding and conscious.
